Every statute below can apply to a business handling Nevada residents' data, depending on your revenue, the number of Nevada consumers you process, and what kind of data you collect. Data Security & Breach Notification · 1
Also requires encryption of personal information in electronic transmission and on data storage devices moved off-premises. Applies regardless of company size whenever you hold covered personal information about a resident of this state.
Consumer Health Data · 1
Washington-inspired law requiring opt-in consent to collect or share consumer health data, with restrictions on sale and geofencing within 1,750 ft of health facilities. Confirmed AG/Commissioner-enforced only — no private right of action — with civil penalties up to $5,000 per willful violation. (Note: this is frequently miscited as starting at §603A.300 — that section is actually Nevada's separate 2019 online-privacy opt-out law; the consumer-health-data law begins at §603A.400.)
